The Frankfurt public Prosecutor’s office has filed a complaint against the non-opening of the main proceedings, in the football summer fairy tale affair. The district court had decided in the last week, that there is no sufficient suspicion of tax evasion against the former DFB President, Wolfgang Niersbach and Theo Zwanziger as well as Ex-General Secretary Horst R. Schmidt. That appeal will now decide the higher regional court in Frankfurt, announced a spokeswoman for the Prosecutor’s office. (Background to the decision of the district court, see here.)

The former DFB-Trio Niersbach, twenties and Schmidt was accused of in the indictment, to have the repayment of € 6.7 million in the Wake of the world Cup organization to the world Federation Fifa disguised. This causes an incorrect tax Declaration had been submitted for the 2006 world Cup year. Corporate, commercial and sales taxes and the solidarity surcharge of about 13.7 million euros had been shortened for the benefit of the DFB, so the charge of the Prosecutor’s office.

The entire scandal goes back to a loan in the amount of the equivalent of 6.7 million euros, the world Cup organising boss Franz Beckenbauer in 2002 by the former Adidas chief Robert Louis-was Dreyfus. Beckenbauer and his then Manager, Robert Schwan forwarded the money to an account in Qatar that was part of the commercial netting of the former and demonstrably corrupt Fifa official Mohamed Bin Hammam. The DFB was not able to clarify through Research of the law firm Freshfields as to the reason for the payment flows.
